The drivers of motor vehicles were at fault in the overwhelming majority of these accidents, 87 percent of the time in the case of bicyclist fatalities.

Legal Rights of Bicyclists and Pedestrians

Pedestrians and bicyclists have the right to seek compensation from the parties responsible for their injuries, whether that person is the driver of a motor vehicle or the owner of the property where the accident took place. In cases in which the automobile driver was intoxicated, the operator of the bar or restaurant that served alcohol to the driver may also be responsible for the injuries.
